Disney Cruise Line is currently dealing with a new lawsuit that has been brought against them due to a situation with a rather unexpected ending. The lawsuit is from a man that was a passenger on a Disney Cruise Line sailing through the Caribbean, and he ended up having his thumb amputated from his hand thanks to a cabin door slamming shut on it.
According to the Orlando Sentinel , the suit was filed in Orlando federal court and has to do with a situation that happened on a Disney Cruise Line sailing on, or around, April 26, 2015.
Marco Fidel Castro was a passenger on one of the ships in the Disney Cruise Line fleet, but it has not been mentioned which of the four. His age was not revealed either, but it was notated that Castro is a grandfather.
Castro and his family were preparing for dinner one night aboard the ship and it just so happened to be the night when the ship was having the “Captain’s Dinner.” While his family was getting dressed and ready to go eat, the horrible situation took place.
Jordan Wagner of Stuart, Florida, is the attorney for Castro, and he explained exactly how the injury occurred.
“He was near the hallway door with his thumb on the door frame, and his wife was holding the door open with her foot. She moved and her foot came away, and he didn’t realize the door was closing. The door slammed shut with force.”
All of the cabin doors on the four ships in the Disney Cruise Line fleet are weighted and do automatically close.
The Disney Cruise Line ship had departed from the Port of Miami and headed out on a Caribbean sailing last April. At the time the injury occurred, Wagner said Castro picked up his severed thumb and went to the infirmary in the ship.
A nurse in the infirmary bandaged up the injury on Castro’s hand and put the thumb in some ice. From this point on, Wagner said he is still attempting to investigate exactly what else may have happened regarding the injury and cruise.
It seems as if Castro did not see another doctor for days after the injury occurred. Upon his first attempt to see a doctor, Castro tried at a port-of-call and there was not an expert available. The next stop was two days later in Puerto Rico and another medical professional was finally seen.
The doctor who saw Castro advised him that nothing could be done as it was now too late to reattach the thumb. Castro and his family returned to the ship.
Now, Castro has filed a lawsuit against Disney Cruise Line alleging negligence and breach of duty. Included in the lawsuit:
- Failure to maintain cruise cabin doors in a safe manner.
- Failure to warn people of the dangers associated with cabin doors.
- Failure to provide timely and adequate medical care.
- Failure to provide safety devices on the hinges of the cabin doors.
Specific details of the suit have not been released, and unspecified damages associated with the costs of medical care and other costs are what Castro is seeking.
Disney Cruise Line’s media office and representatives have not yet said anything about the incident or lawsuit, according to My Fox 8 .
So far this year, Disney Cruise Line has had a rather eventful bit of news with numerous sailings, rescuing an Anonymous hacker , and now a passenger amputating his thumb in a cabin door. The current lawsuit is ongoing and still being investigated.
