John Boehner is filing an abuse of power lawsuit against President Barack Obama . The House Speaker stated after making the Wednesday announcement that the Obama lawsuit is not about impeachment but forcing the president to “faithfully execute the laws” of the United States.
The House Speaker maintains that President Obama has not only ignored the law but “brags” about breaking it in what John Boehner feels is an attitude of both “arrogance and incompetence.” Boehner has reportedly been weighing the decision to file the abuse of power lawsuit against the president for several day. The Republican feels that Obama has exceeded the constitutional authority of the executive as carved out in the Constitution by the Founding Fathers. The “pen and phone” comment by President Obama has often been cited as a phrase of contempt for both the Constitution and the balance of powers as designed for the three branches of government.
John Boehner also noted his concern and frustration over President Obama’s strategy for making policy changes without the approval of Congress and cited currently pending and highly controversial rules. The Speaker also pointed out the multitude of changes to Obamacare after the law was passed and without a vote of approval by Congress, among his reasons for filing the abuse of power lawsuit.
Boehner also added this about the reasons behind the lawsuit:
“My view is the president has not faithfully executed the laws. What we have seen clearly over the last five years is an effort to erode the power of the Legislative Branch. On one matter after another during his presidency, President Obama has circumvented the Congress through executive action, creating his own laws and excusing himself from executing statutes he is sworn to enforce, at times even boasting about his willingness to do it, as if daring the America people to stop him.”
The decision to sue the president by Boehner must be officially approved by the House of Representatives leadership before the lawsuit can go forward. The U.S. House of Representatives would be the plaintiff in the case. When asked about the pending Obama abuse of power lawsuit, White House Press Secretary Josh Earnest said, “It seems that Republicans have shifted their opposition into a high gear. Frankly, it’s a fear that I didn’t know previously existed.”
