Halle Berry To Seek Indefinite Retraining Order Against Gabriel Aubry

Actress Halle Berry is planning to seek a more permanent restraining order against ex-husband Gabriel Aubry when the two meet in court later this week.

A judge issued a temporary restraining order for Halle Berry, daughter Nahla, and fiance Olivier Martinez after Aubry alleged attacked Martinez on Thanskgiving Day and he did so right in front of 4-year-old daughter Nahla.

The emergency order of protection issued against Aubry will expire on Tuesday. The current order requires Gabriel to stay 100 yards away from all three people involved in the Thanksgiving attack.

According to several sources, Berry will seek to have the current order of protection extended indefinitely.

The Thanksgiving Day fight was bad enough to land both Gabriel and Olivier in the same ER. Following the incident, Gabriel was arrested on a charge of criminal battery.

Berry will argue in court that Gabriel’s inability to control his anger in front of Nahla has caused and will cause further emotional trauma. Berry’s lawyers will also argue that Gabriel Aubry’s hatred of Olivier Martinez will likely lead to more unwanted confrontations at some point in the future.

This is not the first time that Halle Berry has taken her ex-husband to court regarding his temper. Berry’s lawyers will have the added benefit of arguing their case in front of the same judge that oversaw Aubry’s last tantrum.

Halle Berry has gone so far as to attempt a move out of the country, asking a judge to give her permission to take Nahla to her residence in France .

No word yet as to whether or not child protective services will get involved with this case as they have in the past.
