Halle Berry seeks an indefinite restraining order against ex Gabriel Aubry, dad to her daughter Nahla, after first obtaining a temporary injunction following a brawl between Aubry and Berry’s new man Olivier Martinez on Thanksgiving . And, now, CPS in Los Angeles is opening an investigation following the incident.
As we reported earlier, Berry’s restraining order isn’t the first time the co-parenting ex-couple has had to deal with what Berry says is Aubry’s anger issues, but this is the first time CPS is said to be getting involved in the situation. In an earlier post on The Inquisitr, we explained:
“Berry’s lawyers will have the added benefit of arguing their case in front of the same judge that oversaw Aubry’s last tantrum … Halle Berry has gone so far as to attempt a move out of the country, asking a judge to give her permission to take Nahla to her residence in France .”
Berry’s restraining order issued during the holiday weekend was an emergency order of protection mandating Aubry stay 100 yards away from three of the people involved in the Thanksgiving dispute — we assume Berry, Martinez, and Nahla.
And Berry’s restraining order could be extended indefinitely, particularly with the involvement of child welfare services in the dispute. RadarOnline spoke to a source, explaining that, after the domestic dispute, the local DCFS was contacted by the LAPD:
“Detectives from the LAPD formally contacted CPS after Gabe’s arrest , because Nahla was present when the fight occurred.”
The source continued:
“Nahla wasn’t actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla’s environment is safe.”
But the source who spoke out after Berry’s restraining order and the subsequent CPS investigation were revealed says that Aubry is hopeful the investigation will be helpful to his case.
“Gabriel is extremely concerned about his arrest and the fallout this could have on Nahla. She is his entire world and is hopeful that once the truth comes out, he won’t be formally charged with any crime.”
Halle Berry’s restraining order against Gabriel Aubry is set to be reviewed in court this week.
