Elizabeth Ruiz has been best known for the racy photos and videos constantly posted to her Instagram page, but now the social media star is gaining notoriety for her alleged threats to release a sex tape with Super Bowl MVP Von Miller.
The Instagram model, who FOX411 described as a “Kim Kardashian wannabe,” has reportedly threatened to release the explicit video of the two taken during a trip to Cancun. The report noted that Elizabeth Ruiz said she would stop the video’s release if the Denver Broncos star would pay her $2.5 million, which Miller’s legal team claims is extortion.
And it appears that for the moment, a judge agrees. TMZ reported on Wednesday that a judge issued a temporary restraining order preventing the release of the sex tape. But in the story, TMZ did not verify whether the report was correct, noting only that Miller went into defensive mode once the sex tape was shopped around.
“That’s when the woman gathered a team and tried to sell the video back to Von for $2.5 mil… Miller claims in the docs. Miller’s people also shot down the request and claimed the woman was trying to extort him.”
There was no immediate confirmation in the court documents that it was Von Miller in the sex tape, but TMZ confirmed through a number of sources that it is indeed the NFL star.
“The Denver Broncos superstar filed legal docs in L.A. County Superior Court under the pseudonym ‘Doe’ — but multiple sources confirm ‘Doe’ is Miller. In fact, he’s described in the legal docs as ‘one of the most talented people at his craft in the U.S. and the world.’”
The court documents went on to claim that Elizabeth Ruiz filmed the sex tape during a trip to Mexico with Von Miller in June of this year. TMZ reported that she filmed it on her cell phone but insisted that it would not be released publicly. When Von Miller later reached out to Ruiz about destroying the tape, she allegedly replied, “Gotcha.”
Legal experts said Ruiz is treading in dangerous water by threatening to release the sex tape with Von Miller.
“To tape someone and then sell a sex tape without the consent of the other partner is not only reprehensible behavior but may well be actionable,” said David Houston, who served as Hulk Hogan’s lawyer in the wrestling legend’s lawsuit against Gawker for publishing a sex tape. “It would be absolutely foolish for a media company to test the water after the Hulk Hogan case. The people of this country appear to have had enough of this type of invasive behavior.”
There are others saying the release of Von Miller’s sex tape would be justified. Nik Richie, who runs the website The Dirty, told FOX411 that unlike Hogan’s case where the video was filmed without the wrestler’s knowledge, it would be justified if media outlets were to publish the video of Von Miller and Elizabeth Ruiz.
“I think the media should publish the tape. It’s not our job or responsibility to protect people for their own mistakes, especially celebrities,” he said.
With more than 325,000 followers on Instagram, Elizabeth Ruiz has gained a large presence in the world of social media celebrities. Ruiz has shared many photos ranging from racy shots to short comedic videos.
A number of comments posters have lashed out at Elizabeth Ruiz since the allegations of her sex tape threat against Von Miller, with some writing on her photos and videos that she is a gold-digger.
For all the alleged threats from Elizabeth Ruiz, it does not appear any of the Von Miller sex tape has been leaked to the internet yet.
