Teresa Giudice is currently serving a 15-month sentence at the Federal Correctional Facility in Danbury, Connecticut, but according to the Real Housewives of New Jersey star, she doesn’t deserve to be there. In a new lawsuit, filed against her former attorney, Teresa Giudice claims she’s currently incarcerated because of “legal malpractice.”
According to a People Magazine report on July 31, Teresa Giudice’s malpractice lawyer , Carlos Cuevas, stated in his complaint that because of her former bankruptcy attorney James Kridel’s “failure” to perform his duties as a lawyer, Giudice is incarcerated “in a federal penitentiary,” and considered “a felon.”
Teresa Giudice’s bankruptcy case began in 2009, weeks after the birth of her youngest daughter, Adrianna.
“The very lawyer retained to prepare accurate bankruptcy documents literally led his client into the cross-hairs of federal prosecutors, and a prison cell. This is a consequence of Defendant Kridel’s several material errors and the concealment of his malpractice,” Cuevas alleged.
When People Magazine reached out to Kridel, he denied the claims made against him.
“She went to jail because she committed crimes, which were not participated in by me. She had about 2.5 hours of testimony before she went to jail where she took full responsibility for the crimes. However, I suppose things have changed in her mind. I have read the transcript and the judge made it very clear that she had originally decided not to send her to jail, but because she had falsified her assets before the sentencing she decided to send her to jail.”
Teresa Giudice and her husband, Joe, were indicted on 39 charges of bank and wire fraud in July of 2013, and a few months later, two more charges were added to the case. In March, 2014, the couple plead guilty, and in October, 2014, they received jail time, as well as a large restitution bill, which totaled over $400,000.
As the Inquisitr previously reported, Teresa Giudice will be forced to hand over 25 percent of her Real Housewives of New Jersey salary for the series’ coming seventh season , for which she will reportedly be paid a whopping $1 million. According to a Radar Online report, Giudice’s $1 million salary had caused a stir amongst her co-stars on the series, who are now allegedly demanding pay raises for themselves.
“Melissa is demanding a significant raise, and wants to be paid $1 million too. Dina Manzo is also seeking a bump in pay. And although producers want Caroline Manzo to come back, she is going to be holding out for a big offer, and she isn’t ready to sign back up for all the crazy drama that comes with being on the show.”
Teresa Giudice will be released from prison on December 23. Once she returns home, her husband, Joe, will begin serving a 41-month term.
