“Snooki,” AKA Nicole Polizzi, the much loved Jersey Law star has slapped a lawsuit on New Jersey-based Excell Brands. Snooki contends that the cosmetics company used her name and the fragrance from her “Snooki” and “Snooki Couture” perfumes on their brand “Snazzy.”
Polizzi filed a suit with the Manhattan Federal Court on Friday alleging that Excell’s “Snazzy” fragrance replicates hers and that they also used her name for marketing their product.
She also claims that the company used her font to emblazon its name prominently on the perfume’s bottle, claiming it looks just like hers. Furthermore, Excell Brands even said in their marketing material about their perfume that “Snazzy” is: “Our version of Snooki by Nicole Polizzi.”
The lawsuit reads: “Without ever seeking, much less obtaining, Ms. Polizzi’s permission or consent, [Excell] disseminated its products and brands containing Ms. Polizzi’s name, likeness, signature and identity.”
The suit goes on to talk about Snooki , offering a whole page on her accomplishments: “[Polizzi] has achieved considerable commercial success in her career by, among other things, maintaining strict control over the projects and commercials endorsements with which she is associated.”
It even goes as far as confirming the list price of the perfume saying that a: “3.3 ounce bottle of Snooki perfume costs $45,” and that, “Customer reviews…. rate it highly.”
Neither Snooki’s lawyers nor Excell Brands were available for comment at the time of this writing.
