Rockland, ME — A Maine man will spend five days in jail for assaulting his estranged wife with his penis after she refused to have sex with him.
Sixty-two-year-old Cushing resident Fred Thomas offered his wife $20 to have sex with him in July when she spent the night at his house. The wife refused. Thomas then took his penis out of his pants and struck her with it.
Thomas had accepted a 180-day jail sentence with all but five days suspended. He was also placed on year-long probation for domestic violence assault and indecent conduct. A third charge of unlawful sexual contact was dismissed.
Thomas’s defense attorney Justin Andrus said his client was extremely upset that his marriage of 39 years was ending. At the time, his estranged wife was preparing to go to Pakistan to meet a man she met online.
Assistant District Attorney Christopher Fernald asked for Thomas to serve seven days in jail. Andrus asked for just probation and no jail.
Judge Jeffery Hjelm, however, decided that jail time was more appropriate in this case.
“This was sexually aggressive conduct. This couldn’t be much more offensive,” Judge Hjelm said.
The estranged wife did not seek jail time, but asked that Thomas undergo counseling for anger management. Judge Hjelm agreed.
Outside of the Knox County Superior Court, Andrus told Bangor Daily News , “This was not his normal conduct.”
