The lawsuit between Modern Family star Sofia Vergara and her ex-fiance, Nick Loeb, over Vergara’s frozen embryos has reached a stalemate, as Vergara is now demanding for Loeb to reveal the names of two former girlfriends who underwent abortions. A California judge has upheld Vergara’s request for the names. Loeb appealed, but the court of appeals sided with Vergara.
Sofia Vergara continues to star in the hit ABC series Modern Family and recently married actor Joe Manganiello, says the Inquisitr . Nick Loeb is a businessman who parted ways with Vergara in 2014, but the two differed on what to do with their embryos. Vergara would like them destroyed, but Loeb wants to implant them in a surrogate and become a single parent.
According to Page Six , Nick Loeb is now saying he would rather go to jail than give up the names of his two exes that had abortions. Sofia Vergara’s lawyers want to question the women under oath to probe Loeb’s sexual past, but Loeb is afraid the women’s names could be leaked and outed years after the event. Loeb says that he will not give up the names.
“I would rather go to jail than reveal the names. I believe we have to protect a woman’s right to privacy.”

Nick Loeb’s lawyers replied to the demand in writing, saying that his former girlfriends have nothing to do with the battle over embryos
“Not only are Plaintiff’s [Loeb’s] privacy rights under attack but so are the rights of third-party individuals who have nothing to do with [Loeb’s] relationship with Ms. Vergara, the embryos or the litigation. [Sofia Vergara is acting in] an attempt to harass third parties to obtain testimony.”

In April of 2015, Nick Loeb wrote an op-ed piece in the New York Times explaining why he believes the embryos have the “right to live” even if Sofia Vergara, the donor of the egg in the matter, wants them destroyed. Loeb explains that he filed a complaint in a Santa Monica, California, court to protect to frozen embryos that he created with his former fiance, Modern Family’s Sofia Vergara.
Although Loeb used pseudonyms, the story leaked anyway, which brought more attention to the topic of embryonic custody when viewed through the lenses of life, religion, and parenthood. Loeb says that there are some key questions that the court must answer because he and Vergara cannot agree.
“When we create embryos for the purpose of life, should we not define them as life, rather than as property? Does one person’s desire to avoid biological parenthood (free of any legal obligations) outweigh another’s religious beliefs in the sanctity of life and desire to be a parent? A woman is entitled to bring a pregnancy to term even if the man objects. Shouldn’t a man who is willing to take on all parental responsibilities be similarly entitled to bring his embryos to term even if the woman objects?”
But Loeb and Sofia Vergara each signed an agreement that said the embryos could only be brought to term only with both parties’ consent. Loeb said because the agreement did not have a specific clause as to what they would do if they broke up, he wants the contract voided.

The conflict has been in the courts for over two years with no resolution, says Radar Online . Loeb says that he would like the two female embryos implanted in a surrogate hopefully before his 86-year-old father passes so that he can meet his grandchildren. Loeb says that he wants no support or involvement of any kind from Sofia Vergara.
