Jennifer Garner: Are Her Children The Reason She’s No Longer Divorcing Ben Affleck?
Jennifer Garner and Ben Affleck will not be moving ahead with their initial plans to divorce following reports that the couple have managed to work on their marital problems in recent months.
The Hollywood duo announced their decision to separate and file for divorce last summer, but according to Celeb Dirty Laundry, it doesn’t look as if Jennifer and Ben are still in the mindset of breaking up now that the actor has moved back into the family home out in Pasadena, California.
On top of that, the news outlet quotes divorce attorney, Jennifer Riemer stressing that a married couple must be living in separate residencies in order for both Affleck and Garner to have their earnings and accumulations divided from one another.

Sources say that Ben and Jennifer did not sign a prenuptial agreement when they tied the knot back in 2005. Following Garner’s announcement to divorce Ben Affleck, the 13 Going On 30 actress also admitted that the twosome were no longer living together in the midst of allegations concerning Ben’s alleged cheating affair with the family’s former nanny, Christine Ouzounian.
Had Ben remained in a different property that wasn’t shared with Jennifer, all the money he has made since their divorce announcement would’ve remained in his bank account. Their divorce settlement would not have included the actor’s earnings, since they had already made it known that they were separated.
Riemer explains, “Basically before [the law changed] the date of separation was when the community property ceases, which is important because if one person is expecting a big bonus, or is filming a movie, those earnings would not be that person’s separate property, because they are not considered separated.”
“Before, even if they were living in the same house, generally a date determined the start of separation. The importance was you could still be living together and be officially separated.”

With this in mind, multiple outlets, including Celeb Dirty Laundry, seem convinced that Jennifer Garner had halted plans to divorce Ben since things have been going better than in recent years, giving her all the more reason to believe that her marriage still has a chance.
Last summer, several reports claimed that Affleck had cheated on Jennifer with Christine Ouzounian, who would later be informed by Garner that her assistance in caring for her children was no longer needed. Jennifer’s decision to fire Christine in the midst of the cheating scandal didn’t help squash the allegations; it actually only worsened them.
And while Ben was said to have spent a couple of weeks with best pal Matt Damon, he eventually saw himself make a return to the $35 million mansion he shares with Garner out in California.

The couple are living under the same roof, Entertainment Tonight reports, but sources do stress that their marriage isn’t back to how it used to be — at least not yet. It’s a work in progress situation, with Ben sleeping in a separate room that’s several floors down from where Jennifer’s bedroom is said to be located.
Their main priority remains to be with the children, and if they see that their marriage still has another shot then Jennifer Garner sees no reason not to try and make it work. After all, in her interview with Vanity Fair, she stresses how much she saw herself spending the rest of her life with Affleck.
