Convicted Subway Spokesman Jared Fogle Challenges His Sentence
Former Subway spokesman Jared Fogle is back in the news, as he is dissatisfied with his sentence for child pornography. He says he should not have been prosecuted for his “sexual fantasies.” The yuck factor increases when Fogle acknowledges that he had fantasies of sex with minors, and even discussed these fantasies on the phone, but that is not a crime.
According to The Inquisitr, Jared Fogle was called a “porn mastermind” by his former assistant, who is also doing time for child pornography. Russell Taylor says that he was manipulated by Fogle, and that at the Jared Foundation office in Fogle’s home, Taylor was just maintaining Fogle’s porn collection.

TMZ is reporting that Jared Fogle has officially filed a complaint about his 15-year sentence, and is already trying to get it modified. Fogle says that the judge at least partially punished him for his fantasies, which many see as deviant. Notes on the judge’s sentence talk about Fogle being obsessed with child porn.
“This defendant is obsessed with child pornography and having sex with minors. He fantasized about it in telephone conversations.”
Fogle’s attorneys say that fantasies, no matter how distasteful, should not be a part of the Subway spokesman’s sentence.
“We are loath to give the government the power to punish us for our thoughts and not our actions.”

WRTV has confirmed that Jared Fogle’s attorney has officially filed an appeal for his fifteen year sentence. Jared Fogle had barely arrived in prison when he started plotting a way to get out early. Fogle had made a deal with the government to do twelve years in prison, and the judge decided that she was within her rights to add on an extra three.
Fogle’s attorney said that this was an abuse of power, and twelve years is enough for Fogle to understand the seriousness of his crime,
“He is experiencing and fully appreciates the painful consequences of his conduct and he will continue to do so. These experiences will serve more than enough motivation for Fogle to never commit such crimes again,” the filing said.
The filing also says that Jared Fogle also sought medical attention for his deviant sexual obsession.

Perez Hilton is reporting that Jared Fogle desperately wants a reduction in his sentence, at least back to the agreed upon 12 years. The argument is based on the idea that the judge was being the thought police, even though the government has proof that Fogle acted on his fantasies of having sex with children.

Hilton put this whole topic under the category of “icky icky poo,” and it seems the public agrees that child molesters and pornographers should not get reduced sentences. Fogle’s lawyer’s argument does have some merit on the basis of facts, but legally, the judge does have discretion over the final sentence.
