Dzhokhar Tsarnaev: Boston Marathon Bomber Requests New Trial To Seek ‘Judgment In His Favor’
Dzhokhar Tsarnaev, better known as the Boston Marathon bomber, is filing to request for a new trial.
As previously reported by the Inquisitr, Dzhokhar Tsarnaev apologized in court for murdering four innocent people and injuring hundreds more at the Boston Marathon with the help of his brother. Remorse aside, Tsarnaev was sentenced to death for the crime and has reportedly had an unpleasant experience in prison while awaiting his execution.
But Dzhokhar Tsarnaev and his lawyers have not given up hope to save the Boston Marathon bomber from the death penalty. According to the Huffington Post, Tsarnaev filed a motion in the U.S. District Court in Boston on Monday requesting a do-over of his trial. At the moment, the motion is only a simply-worded placeholder for a more in-depth request that will be filed in a few weeks. Dzhokhar Tsarnaev does not reveal the full grounds on which he wants to appeal his trial, but it does claim that the evidence was insufficient to convict him for the Boston Marathon bombing.
“A new trial is required in the interests of justice and judgments notwithstanding the verdict are required as a matter of evidentiary insufficiency,” says the motion, written by his lawyer Judy Clarke.
According to the Boston Herald, the legal team of Dzhokhar Tsarnaev is openly admitting their plans to seek a verdict “in his favor,” presumably to get the 21-year-old off of death row.
While the request for a brand new trial might be appalling to those who witnessed the carnage caused by Dzhokhar Tsarnaev and his brother at the Boston Marathon, the motion is not a legal anomaly. Northeastern University law professor Daniel Medwed claims the defense attorneys are simply making sure they haven’t missed any legal opportunities to reduce Tsarnaev’s sentence.
“The defense wants to make sure it doesn’t waive its right to challenge any particular issues,” Medwed explained. “They’re exercising caution.”
However, according to My Fox Boston, the defense team is labeling the new trial as absolutely necessary for the sake of finding justice. Despite omitting their grounds to defend Dzhokhar Tsarnaev in the motion, the lawyers claim an appeal trial is “required in the interests of justice.”
