Halle Berry and Gabriel Aubry were back in court on Friday for a private confidential hearing regarding Aubry’s ability to maintain his current custody arrangement with Halle Berry and sources say representatives from the L.A. County Department of Children and Family Service sat in on that meeting.

Daughter Nahla was present and the meeting comes just after Berry made a request to move with her daughter to France.

Records from the celebrity couples case are being kept under tight wraps however it’s no secret that Aubry’s nanny had requested a restraining order against him after claiming that he shoved her into a door while she was holding daughter Nahla. That request was ultimately denied but protective services is required to investigate all claims of child endangerment.

For her part Halle Berry claims she wants to move to France because of a mentally ill patient who has repeatedly threatened her life in the past. That same mentally ill patient also promised to slit Madonna’s throat in the 1990’s and escaped from his L.A. mental health facility on Friday only to be caught my police 8 miles from the facility.

A second patient who was also stalking Halle Berry was released from prison just last week.

Do you think Halle Berry will eventually be given permission to take Nahla out of the country so they can live in France?
